Violation Notice


City Ordinances prohibit:
  • Vehicles parked in a front yard setback and on medians
  • Oversized vehicles parked in residential zones
  • Parking vehicles on sidewalks
  • Extensive auto repairs being performed in a residential zone
  • Illegal Parking
  • Infraction Deferral Program
  • Snow Removal Conditions and Procedures
Concerns regarding parking violations and abandoned and unlicensed vehicles should be reported to the Traffic Division.

ILLEGAL PARKING:
Any person charged with violating the stopping, standing, or parking restrictions under City Ordinance may, within twenty-four (24) hours from the time of issuance of notice of violation, pay a fine of Fifteen dollars ($15.00) to the Traffic Clerk at the Michigan City Police Building, 102 W. 2nd Street, between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday inclusively. However, said twenty-four (24) hour grace period shall carry over the weekend or any holiday to the next business day. Said person may, between twenty-four (24) and seventy-two (72) hours of the time of notice of violation was issued, pay to the Traffic Clerk at the Michigan City Police Building a fine of twenty-five dollars ($25.00). If not paid after seventy-two (72) hours, the fine of Fifty dollars ($50.00) can be paid until such time as the notice of violation is sent to the City Attorney for prosecution, which may result in the suspension of the vehicle's registration.

INFRACTION DEFERRAL PROGRAM
The LaPorte County Prosecuting Attorney, in accordance with Indiana Law, has established an Infraction Deferral Program. It benefits primarily law-abiding individuals who have been charged with certain moving traffic offenses.
Eligibility requirements are:
  • Violation was not associated with an accident
  • No criminal charges resulted from the violation
  • Individual has not been charged with a criminal or traffic offense within the last two (2) years in any state
If eligible for the Infraction Deferral Program, and the program is successfully completed, the violation will be dismissed. A driving conviction for this offense will not be added to the individual's driving record.

If not eligible for the Infraction Deferral Program, the person may either plead guilty and pay the appropriate fine and court costs, or plead not guilty and proceed to trial.

SNOW REMOVAL CONDITIONS & PROCEDURE

Find Off Road Parking Immediately
If a Snow Removal Condition was ordered, your vehicle can be towed at the owner's expense. Violation of the City Ordinance is not less than a $25.00 fine, plus towing costs. Vehicles must be off the paved portion of the roadway leaving enough room on the City Right-Of-Way for the snow to be plowed. Vehicles may not block or be parked on the sidewalk. Snow Removal Conditions will be announced on local radio stations and newspapers.

REMEMBER: WHEN IT'S SNOWING, THE ORDINANCE MAY BE IN EFFECT

Phase I of Snow Removal Condition
No person shall park a vehicle on a SNOW ROUTE, or on the NORTH or WEST side of any other street, except as the Board of Public Works & Safety may make certain exceptions to this prohibition.

Phase II of a Snow Removal Condition
No person shall park a vehicle on a SNOW ROUTE, or on the SOUTH or EAST side of any other street, except as the Board of Public Works & Safety may make certain exceptions to this prohibition.

Section 94.255 of the Michigan City Snow Removal Ordinance, "TOWING AND IMPOUNDING OF STALLED OR ILLEGALLY PARKED VEHICLES", reads:

   (A) Any vehicle parked in violation of this chapter may be towed away and
        impounded at the owner's expense.

   (B) Any vehicle parked, stalled, incapable of moving under it's own power, or left
        unattended in any prohibited area during a SNOW REMOVAL CONDITION,
        may be towed away and impounded at the OWNER'S EXPENSE.
